FDA, FTC and Prop 65 Label Review in 48 Hours: How an Indian Cosmetics Brand Fixed Its Claims Before a US Launch (2026)
A cosmetics brand from India preparing for a US launch needed its label cleared under three sets of rules at once, with very little time before sales started. GOL reviewed the label against FDA labeling rules, FTC advertising rules and California Proposition 65, and completed three full rounds in 48 hours.
At a glance
| Market | United States, including California |
| Product | Cosmetics, made in India |
| Regulations reviewed | FDA labeling, FTC advertising claims, Proposition 65 |
| Main finding | A "100% satisfaction" claim and a 96% results claim the FTC would treat as unsupported |
| Turnaround | 3 review rounds in 48 hours |
| Outcome | Claims fixed before the first sale |
The challenge
The brand had a launch date set and artwork nearly ready. It needed to be sure the label met FDA cosmetic labeling requirements, that its marketing claims would hold up under the FTC, and whether a Prop 65 warning was needed for California customers. A standard review, at 5 to 7 business days per round, would have missed the date.
What we did
- Round 1: reviewed the full label against all three rulebooks and sent one report listing each issue, the rule behind it, and the change needed.
- Round 2: checked the revised artwork and confirmed which issues were closed.
- Round 3: final check of the print version, so the file sent to the printer was the file we reviewed.
What we found
The serious findings were under the FTC, which requires every claim to be truthful and backed by evidence at the time it is made. Two claims on the pack failed that test.
Claim 1: "100% satisfaction"
The problem. No brand can measure that every single customer is satisfied, so the number cannot be accurate. An absolute figure like this is treated as an unsupported claim.
The fix. The claim was removed from the label.
Claim 2: "96% saw improved results"
The problem. The figure came from a clinical test the brand ran itself, on a very small sample. Shown on its own, a shopper would read it as a broad, independent result.
The fix. An asterisk was added, with a note explaining how the 96% was calculated and where it came from, so shoppers can see what the number is based on.
GOL Insight
A disclosure tells shoppers what a number means. It does not make a weak study strong. Small, in-house tests can support modest wording, but a headline percentage aimed at US shoppers is safer with a larger or independent test behind it. Claims are also where label reviews most often find problems a designer cannot fix alone, so flagging them in round 1 kept the 48-hour timeline intact.
The outcome
- "100% satisfaction" removed and the 96% claim disclosed before sales started, so the brand launched without the FTC exposure.
- Three full review rounds in 48 hours, against a typical three to four weeks on standard timing.
- One review covering FDA, FTC and Prop 65, with one report per round.
Why it matters
Not every brand acts on the report. In four real label cases, the two clients who skipped or changed the advice ended up with goods held at the port and a shipment destroyed. The difference was not the label problem itself. It was when it was fixed.

FAQ
Can a label be reviewed under FDA, FTC and Prop 65 at the same time?
Yes. We review all three in one pass and return one report per SKU, so your designer makes one set of changes per round.
How fast can a rush review go?
Rush rounds take 1 to 2 business days each. In this case, three full rounds were completed in 48 hours.
What counts as an untruthful claim under FTC rules?
Any claim that is false, misleading, or not supported by evidence at the time it is made. Health and performance claims need competent and reliable scientific evidence.
